CLAIMS UNDER STATE LAW 

 

 

State-based tort law is often used to seek civil liability for corporate actors that physically and/or psychologically harm workers and/or surrounding communities in connection with business activities. In common law jurisdictions, torts are civil wrongs that a legal person commits against another in violation of a duty of care. Civil claims based on violations of state law can be used to hold corporations accountable, but claimants face similar and sometimes additional procedural challenges as they do in cases based on federal statutes.
